Family Requests Outgoing Wico. State's Attorney for Murder Trial

SALISBURY, Md. - The family of a murdered child announced their "unwavering desire" for the outgoing Wicomico County State's Attorney Davis Ruark to continue as lead counsel for next year's trial.
 
Thomas Leggs Jr., 30, of Salisbury, is accused of kidnapping, raping and killing 11-year-old Sarah Haley Foxwell last Christmas.
 
Ruark was ousted in the Democratic primary by W. Seth Mitchell. The Republican candidate in the race, Matt Maciarello, has since announced that if elected, he intends to bring back Ruark as lead prosecutor in the Leggs' trial. His opponent, Mitchell, has responded that his office will put a competent person in charge. But Sarah's mother, grandfather and aunt have clearly outlined their wishes.
 
"We are confident that Mr. Ruark is the person to prosecute Thomas Leggs Jr. for the unspeakable acts committed upon Sarah... It is our unwavering desire that Davis Ruark, with the support of his choice of attorneys and staff, continues in the role of lead counsel for the State," wrote Jennifer Foxwell, Thomas Foxwell and Amy Fothergill in a signed letter.
 
Ruark said he takes the request to heart.
 
The general election takes place Nov. 2, 2010, with an office turnover to follow in the new year. The Leggs' trial is set in Cecil County for April 2011.
