DSU wins Partial Ruling in Discrimination Case

Posted:

DOVER, Del. (AP) - A federal judge in Wilmington says a white volleyball player has failed to prove that she was the subject of racial discrimination and a racially hostile environment at the historically black Delaware State University.

But Judge Richard Andrews ruled Wednesday that Sara Elliott could proceed with claims that she was targeted for retaliation by the school's volleyball coach after complaining about racial discrimination.

According to court records, Elliott began having problems with a black suitemate shortly after she arrived at the Dover campus in 2009.

Andrews said there was evidence that Elliott suffered racial insults from her roommate and others. But he said she failed to establish a hostile environment claim or that her coach or a residential director treated her differently from similarly situated nonwhite students.
