Del. Supreme Court Still Mulling Death Penalty Case

DOVER, Del. (AP) - The Delaware Supreme Court is asking a lower court for more information before ruling on a request by prosecutors to reinstate a former death row inmate's murder conviction.

A Superior Court judge overturned the conviction of Jermaine M. Wright in January, saying his police confession was defective and that he was not properly advised of his rights following the 1991 murder of liquor store clerk Phillip Seifert. The judge also said Wright's attorneys were never given potentially exculpatory information suggesting that Seifert may have been murdered by two men who tried to rob another liquor store a short time before.

The justices sent the case back to Superior Court this week to determine whether the defense, as prosecutors claim, knew about the earlier robbery anyway, despite prosecutors' failure to disclose it.
