Federal Judge Dismisses Killer's Prison Lawsuit

DOVER, Del. (AP) - A federal judge has dismissed a lawsuit filed by a convicted killer who claims Delaware prison officials violated his constitutional rights.

Freddy Flonnory, a former death row inmate now serving life in prison for a 1997 double murder, claimed prison officials unfairly moved him to a more secure prison unit and prohibited his fiancee from visiting him after he was found with contraband cash in 2009.

Flonnory said officials failed to discover the cash when it was mailed to him, but found it only when he tried to pass it on to his fiancee. He argued that he should not be penalized for the mistakes of prison officials.

The judge on Thursday dismissed the lawsuit as frivolous, saying it was filed too late.
