Md. Lawmaker's Attorney Appeals 30-Day Jail Sentence

ANNAPOLIS, Md. (AP)- The attorney for a Maryland lawmaker sentenced to 30 days in jail for operating a motorboat under the influence of alcohol has filed an appeal.

David Fischer appealed Anne Arundel District Court Judge Robert Wilcox's decision shortly after Del. Don Dwyer's sentence was announced. That means the case will go to Anne Arundel County Circuit Court. It stays the sentence pending action in the higher court.

Dwyer pleaded guilty to operating his boat under the influence of alcohol.

Dwyer and Fischer held a news conference Monday to announce his plans to plead guilty. The plea deal they discussed did not include incarceration. Dwyer admits his blood alcohol content was three times the legal limit, but he says an August crash on the Magothy that injured several people wasn't his fault.
