Delaware Legislators Add to Habitual Offender Law


DOVER, Del. (AP) - The state House has given final legislative approval to a bill adding the use of a gun during a felony to the list of crimes that can be used to declare a person a habitual criminal offender.

House members voted unanimously Sunday for the bill, which increases the potential penalties imposed upon repeat offenders convicted of using a firearm during a felony.

The bill was unanimously approved by the Senate in May and now goes to Democratic Gov. Jack Markell for his signature.

Under the habitual offender law, a person who has been convicted twice for violent felonies or attempted violent felonies can be sentenced to life in prison as a habitual offender upon a third such conviction.
