ANNAPOLIS, Md. (AP) - Maryland's highest court has overturned the ousting of an Anne Arundel County councilman who was convicted of failing to file a tax return.
The Maryland Court of Appeals issued the 4-3 ruling on Monday in the case of former Councilman Daryl Jones.
The majority of judges found that the Anne Arundel County Council did not have the authority to remove Jones. They ruled Jones did not move his residence when he went to South Carolina to serve five months in a federal prison. Jones was released in December. He appealed a court ruling on the council's action.
The case has been sent back to Anne Arundel County Circuit Court to decide whether he can return to office.
In March of 2012, the council appointed Peter Smith to Jones' seat.
