Courtroom Facebook Post Results in Lawsuit


VIRGINIA BEACH, Va. (AP) - A Facebook post from a Virginia Beach courtroom has resulted in one local attorney suing another and a crackdown on cellphone use in the city's court.

Defense attorney Daniel Miller published a photo on Facebook showing defense attorney John Swango at the bench with his client in the city's general district court.

Swango appeared in the photo with a caption saying that the stain in his client's jail suit occurred when he realized who his attorney was.

Swango claims in a lawsuit the post contained false information that hurt is reputation. He's suing Miller and his law firm for $600,000. In his response, Miller says he was expressing an opinion that is a protected form of speech. He's asking for the lawsuit to be dismissed.
