SNOW HILL, Md. (WBOC/AP)- A man accused of the 2012 murder of a Sussex County church worker will face charges in Delaware, not Maryland where he was previously charged.

Delaware State Police on Monday announced that 29-year-old Matthew N. Burton of Dagsboro will face first-degree murder and first-degree rape charges in the death of 35-year-old Nicole Bennett of Millsboro. Bennett, a mother of three, was found dead in Maryland's Worcester County in June 2012, and Burton was previously charged there. But authorities said an investigation found evidence indicating the crimes were actually committed in Delaware.

Maryland has dropped its charges, and Burton will be extradited to Delaware.

Bennett's husband reported her missing to Delaware State Police on June 15 after she did not return home from her job at Bay Shore Community Church in Gumboro, where Burton worked as a custodian.

Burton, who is Tier I sex offender in Delaware, was taken into custody following a July 6 traffic stop.
