Suit Against Church in Woman's Slaying to Proceed

WILMINGTON, Del. (AP/WBOC)- A Superior Court judge has refused to dismiss a lawsuit against a Gumboro church filed by the husband of an employee who was kidnapped, raped and killed, allegedly by another employee.

The judge on Wednesday denied Bay Shore Community Church's request for a dismissal of a suit brought by the husband of 35-year-old Nicole Bennett. Bennett, who led a daycare program at the church, was found dead in June 2012 in an embankment off of Swamp Road in Worcester County, Md. An autopsy determined she was asphyxiated.

Twenty-nine-year-old Matthew N. Burton of Dagsboro is charged with first-degree murder in Bennett's death. The suit alleges that Burton, a convicted sex offender, was fired by the church's pastor, and his last day at work was when Bennett disappeared.

The suit accuses the pastor and the church of negligence in hiring and supervising Burton.
