Del. Supreme Court Overturns Murder Conviction


WILMINGTON, Del. (AP)- A Delaware Supreme Court panel has overturned the murder conviction of a man accused of shooting another man during a drug deal.

The true-judge panel ruled on Tuesday that Davear Whittle's conviction of second-degree murder must be sent back to Superior Court for a re-trial.

Whittle was convicted in October 2012 in the death of 35-year-old Donald Williams of Philadelphia. The slaying took place in August 2010 in Wilmington.

Chief Justice Myron Steele wrote that Deputy Attorney General Steve Wood repeatedly argued during closing that the state's witnesses were "right" and "correct" in their testimony. Steele says Wood's actions amounted to "improper vouching."
