RICHMOND, Va. (AP)- A patient at a state-run psychiatric facility for sex offenders says a magistrate has rejected his attempt to press charges against a security guard who attacked him.
William Dewey says in a telephone interview that he received a letter Thursday from the magistrate who conducted a hearing last week at the Virginia Center for Behavioral Rehabilitation in Burkeville. The magistrate said he found no probable cause to prosecute the guard for misdemeanor assault and battery.
Dewey claims he was assaulted by the guard and other employees in June. He filed an abuse complaint, which was substantiated after an investigation by the center's human rights advocate.
According to state officials, there were 42 incidents leading to 56 findings of abuse and neglect at the center in 2001 and 2012.
