Officer Report Says Hard to Prove Assault in Navy Case


ANNAPOLIS, Md. – It will be difficult, if not impossible, to prove two former U.S. Naval Academy football players sexually assaulted a female midshipman, according to a report by one military officer.

The report says the woman's contradictory and misleading testimony has damaged her credibility.

The Naval Academy's superintendent court-martialed Midshipmen Josh Tate and Eric Graham last month. The investigating officer's report recommended against court-martialing the accused.

Attorney Susan Burke, representing the alleged victim, says prosecutors in the case have not been effective and says she is concerned the investigation was not done properly.

The attorneys for Tate and Graham say political pressure surrounding the military's efforts to eliminate sexual assault has pushed the case forward.
