Felton Man Arrested for Criminally Negligent Homicide

FELTON, Del.- Delaware State Police detectives have arrested a Felton man for criminally negligent homicide in connection with the Easter Sunday death of a 30-year-old man.

Police said detectives obtained a warrant for 48-year-old John E. Hart on Tuesday after the investigation into the death of Michael A. Mosley of Felton was ruled a homicide by the Office of the Chief Medical Examiner.
 
According to police, Hart's arrest stemmed from an incident that occurred early Sunday, March 31, at 8730 Canterbury Road near Felton. Police said a 9-1-1 call was placed by a female resident stating her daughter's boyfriend was found unconscious outside the home. Mosley was pronounced dead at the scene by emergency responders. 

Authorities said Mosley was removed from the scene by the Office of the Chief Medical Examiner and an autopsy was performed on April 1 ruling the cause of death as pending until additional studies could be completed. The medical examiner later ruled the manner of death as a homicide with the cause being asphyxia, police said.
 
Through interviews and evidence collected at the scene, detectives said they determined that Hart and Mosley had begun drinking heavily Saturday night into Sunday morning while they were out in a detached garage working on an automobile. Police said that at one point, the two got into a fight when Hart ultimately held Mosley down on the ground and placed his face into the dirt until he was no longer able to fight back.
 
Hart was taken into custody Tuesday evening on the aforementioned charge and ordered held in lieu of $7,500 cash only bond.
