Bodenweiser to be Retried in Sex Abuse Case

GEORGETOWN, Del. (WBOC)- Former Delaware state Senate candidate Eric Bodenweise will be retried in the sexual abuse case against him, it was announced Tuesday.

"After reviewing the case, the Delaware Department of Justice has decided to move forward with prosecution of Eric Bodenweiser, and retry the case," said Joe Rogalsky, director of legislative affairs for the attorney general's office, in a statement released Tuesday afternoon.

It was back in June that a mistrial was declared after a jury could not agree on Bodenweiser's guilt or innocence on any of 15 counts. Bodenweiser, 55, of Georgetown, is accused of having a sexual relationship with a young boy over 20 years ago.

Bodenweiser's attorney, Joe Hurley, told WBOC on Tuesday that the defense will file a motion for a change of venue due to the amount of publicity in the first trial. A meeting is set for July 23 to schedule a hearing for change of venue.
