Man Facing Charges for Assaulting Police Officer Headed Back to Court

GEORGETOWN, Del. - A man who is facing charges for assaulting a police officer, will be heading back to court for the second time. This follows a mistrial the first time around. 

Michael Rogers was arrested in August of 2013 when Delaware State Police said a police questioning turned into a violent struggle. Police said that shortly after 10 p.m. on Aug. 1, 2013 the trooper went to the Deep Branch Road home of 53-year old Rogers to question him about his involvement in a crash that occurred earlier that evening. 

Police said Rogers was highly intoxicated and created a violent struggle. As a result, the trooper fired his gun several times, striking Rogers five times. 

The mistrial in Roger's initial case, was due to a hung jury. Now the Attorney Generals office has decided to re-try Rogers on November 17 at the Superior Court in Georgetown.
