Va. Man Pleads Guilty to Tapping Fund for Ill Boy

DINWIDDIE, Va. (AP) - A Dinwiddie County man has pleaded guilty to taking more than $100,000 from a trust fund established to help pay a 9-year-old boy's medical bills.

Floyd W. Abernathy III and his wife set up the fund in 2004 for Baylor Lindsay, who has a rare blood disease.

The Richmond Times-Dispatch ( ) reports that Abernathy pleaded guilty Tuesday to misdemeanor embezzlement. He received a 12-month suspended sentence and made restitution of $144,355.

An indictment issued earlier this year charged Abernathy with five felony embezzlement counts. In exchange for his plea, Dinwiddie Commonwealth's Attorney Lisa Caruso withdrew those counts.

Caruso says the boy's family is satisfied with the case's outcome.
