Court Rules Suspect in Md. Should be Extradited to Del.

SNOW HILL, Md. (AP/WBOC) - Maryland's second-highest court has ordered that a man held in the state and charged with the rape and murder of a woman whose body was found in Maryland should be extradited to Delaware.

Matthew Burton, 30, is charged in the slaying of 35-year-old Nicole Bennett in June 2012. Bennett was found dead in Worcester County. She was last seen at her job at a church in Gumboro, Delaware. Burton, a custodian at the church, was arrested in July 2012 near Rehoboth Beach, Delaware.

Burton was extradited to Maryland and indicted. But an investigation found evidence indicating the crimes were committed in Delaware.

On Oct. 8, Maryland's Court of Special Appeals rejected Burton's appeal to stay in Maryland.

The court ruled that he must be returned to Delaware to stand trial.

Though it is likely Burton will eventually be extradited to Delaware, Worcester County State's Attorney Beau Oglesby says Burton can appeal again in the next couple weeks.
