Man Wounded in Shootout at Del. American Legion

DOVER, Del.- Dover police say a 26-year-old man was injured during a shootout that occurred over the weekend at the American Legion on Bay Road.

Police said the shootout occurred at around 1 a.m. Sunday as a party was going on inside the American Legion, which had been rented out by a group unaffiliated with the veterans' organization. When officers arrived on the scene, they said they observed several spent 9mm shell casings on the northeast side of the parking lot, near a picnic area, as well as 9mm and .380 shell casings on the northwest side, which were indicators that gunfire was exchanged between at least two parties.

Authorities said that during the exchange of gunfire, a 26-year-old man was shot in the left hip. He is currently listed in serious but stable condition.

Police said that while officers were attempting to clear the parking lot of remaining persons, an officer was standing next to an occupied vehicle when a gunshot was fired from within the vehicle. The officer, who was unharmed, immediately took the occupants of the vehicle into custody with aid from other Dover officers. Officers said they then located a black Jennings 9mm handgun in the rear of the vehicle. They said a further investigation revealed that 30-year-old Darnell Waples was in possession of the gun and fired it accidentally as he was trying to conceal it in the vehicle.

Waples was arrested was charged with two counts of possession of a firearm/ammunition by a person prohibited, possession of a firearm during the commission of a felony, carrying a concealed deadly weapon and first-degree reckless endangering. He was ordered held in the James T. Vaughn Correctional Center in lieu of $32,500 secured bond. 

Police said that in all, shell casings from three guns were found at the scene and they are working to identify everyone involved. Police said further charges are pending the outcome of ballistics analysis.
