Environmental Group Plans to Sue Over Coal Ash in Va.

CHESAPEAKE, Va. (AP) - The Southern Environmental Law Center says it has sent notice to Dominion Virginia Power that it intends to bring a lawsuit under the Clean Water Act to clean up leaking coal ash pits at the Chesapeake Energy Center on the Elizabeth River.

Dominion said in a statement Friday that it is reviewing the notice, but that it plans to vigorously oppose it.

Dominion says the Chesapeake Energy Center isn't online and that it plans to close it at the end of the year. Dominion says it has submitted an ash closure plan to environmental regulators, which includes a cap and cover solution.

The Southern Environmental Law Center contends the coal ash should be moved to a dry, lined storage facility away from waterways.
