DOVER, Del. (AP) - Gov. Jack Markell says an incumbent fellow Democrat will remain serving as Kent County's recorder of deeds amid a legal fight over the November election.

Markell's office said Monday that Betty Lou McKenna will remain as recorder until her successor is "duly qualified."

Officials said the appointment will give the Delaware Supreme Court time to decide the appeal of McKenna's Republican challenger, La Mar Gunn, and avoid the possibility of an interruption when McKenna's current term expires Tuesday.

State GOP chairman Charlie Copeland had asked Markell earlier Monday to appoint Gunn to the post.

Gunn led after the election by only two votes. He also led after two recounts, but McKenna was declared the winner after a third recount.

A fourth recount ended in a tie and the office declared vacant.
