Tatem Found Not Guilty of Murder

SALISBURY, Md. - A Wicomico County man accused of murdering an elderly man in his home last April is found not guilty.

After only three hours of deliberation, early Thursday morning a Wicomico County jury found 35-year-old Paul Tatem not guilty of first- and second-degree murder and first- and second-degree attempted murder as well as two counts each of armed robbery and other related charges. The jury did find Tatem guilty of one charge: possession of a firearm with a felony conviction.

Tatem was accused of murdering 72-year-old Donald Mariner. Mariner was found dead in his home on Pemberton Drive last April.

The prosecution's case failed to convince the jury that Tatem broke into Mariner's home to intentionally rob and murder Mariner and his roommate, Creston Pumphrey, who says he was also attacked.

The not guilty verdict was a sign of relief for Tatem but a heavy sign of disappointment for the family and friends of Mariner to hear the person responsible for his death is still out there.

Wicomico County State's Attorney Matt Maciarello said, "We had confidence in our case. We presented every bit of evidence and the jury has spoken."

"Theme of the case from opening to closing was that literally every person involved in the case was not telling the truth. People lie for different reasons but everybody in this case was," said Tatem's attorney David Weck.

Sentencing for Tatem's illegal possesion of a firearm is set for Friday.
