GEORGETOWN, Del. (AP/WBOC)- An attorney for a man whose kidnapping conviction was overturned is seeking dismissal of new charges involving the abduction of an 89-year-old woman who was locked in her car trunk for two days.

A Sussex County judge is set to hear arguments Friday in the case of Rondaiges Harper, who was sentenced to 30 years in prison on kidnapping, carjacking and conspiracy charges.

The state Supreme Court overturned his convictions earlier this year, ruling that the carjacking was completed before Harper's involvement.

Harper subsequently was charged with unlawful imprisonment and conspiracy.

Harper is one of four young people charged in the 2013 kidnapping of Margaret Smith. The other defendants pleaded guilty.

Authorities say Smith was kidnapped after two teenage girls asked for a ride home from a Milford convenience store. She was stuffed in the trunk of her own car for almost 48 hours before dumping her in a secluded cemetery in Seaford, according to authorities.

    Sinking House Near Fenwick Island

A house is making its way into the bay near Fenwick Island and boaters warn against the dangers of debris in the water.

Robert Mitchell, The Director of Environmental Programs for Worcester County, said that nearly 500 acres of land was given to them in a deed.

Little did they know there would be a small house located on one of the many islands they acquired. A house, that they soon found out, is sinking into the water.
