Judge Rules Against Lawmaker in Home Improvement Lawsuit

DOVER, Del. (AP) - A Chancery Court judge has rejected a Delaware lawmaker's challenge of an $86,000 arbitration award involving a home-improvement contract.
    
The judge on Wednesday confirmed a contractor's arbitration award regarding unpaid work on the home of Rep. Charles Potter Jr., a Wilmington Democrat, and his wife, former state treasurer Velda Jones-Potter.
    
The judge said the Potters' petition to vacate the award was filed too late.
    
The Potters have argued that the work was not done to their satisfaction, and that a mandatory arbitration provision was unenforceable against Potter because he did not sign the contract. A Superior Court judge dismissed their counterclaim.
    
The arbitrator in 2014 awarded the contractor more than $86,000, plus interest, for breach of contract, as well as attorney's fees.
    
The case now moves back to Superior Court.
