Judge Dismisses Lawsuit Over Fatal Police Shooting of Man

Posted: Updated:

DOVER, Del. (AP)- A federal judge has dismissed a lawsuit filed by the fiancee of a man who was fatally shot by New Castle County police in 2012.

The judge ruled this week that Jennifer Thomas had no standing to bring the lawsuit over the death of James Green because she has failed to show that she is executor of his estate.

Green was fatally shot in August 2012 as police responded to a report of a shooting. Police said at the time that Green, 27, had shot at a neighbor, and was then shot by police as he was leaving the scene.

Authorities said that after police stopped his car, Green ignored repeated commands to show his hands, reached toward the center console of his car, and then drove toward an officer.
