Delaware Lawmaker Eyes Appeal After Train Idling Law Voided

DOVER, Del. (AP)- A Delaware lawmaker is hoping to appeal the federal government's recent decision to strike down a state noise-reduction law limiting how long trains can sit idle.
    
State Sen. David McBride, who sponsored the bill, said in a statement that the law is fair and that the U.S. Surface Transportation Board has a history of siding with railroads during disagreements with state governments.
    
The New Castle Democrat says he wants to appeal the board's ruling last week that the bill violates federal jurisdiction over rail carriers.
    
The bill was drafted in response to Norfolk-Southern Railroad's idling of bulk oil trains traveling to the Delaware City Refinery. The bill had banned idling between 8 p.m. and 7 a.m. when not necessary for the safety of crews and operations.
