Millsboro Man Arrested for 4th DUI and Drug Charges

SEAFORD, Del.- Troopers arrested a Millsboro man for his 4th  DUI and heroin possession after several people reported his erratic driving.
 
Delaware State Police around 1:30 p.m. Saturday, the Sussex County Emergency Operations Center began receiving calls about a car driving erratically on southbound Sussex Highway south of Seaford.  The car was then reported to be stopped in the right turn lane at the intersection near Ockels Drive with the operator slumped over the steering wheel.  

Troopers located the white Chevrolet Cavalier and contacted the driver, who was identified as 29-year-old Philip Spear, of Millsboro. Police say they detected an odor of alcohol and while interviewing Spear, troopers saw an empty heroin bag stuck to the outside of his shirt.  

A state police K9 then conducted an exterior search and alerted troopers to the presence of drugs in the car. When troopers searched the car, they found three bags of heroin with a weight of .045 grams as well as syringes and other drug paraphernalia.  

A DUI investigation ensued and Spear was transported back to Troop 5 where an inquiry into his driving record revealed he had three previous DUI convictions (06/07/06, 08/23/10, and 06/04/13).
 
Spear was charged with 4th-Offense Driving Under the Influence of a combination of alcohol and any drug, possession of heroin, and possession of drug paraphernalia.  He was arraigned a JP3 and committed to Sussex Correctional Institution on $5,000 cash bond.
