5 Charged With Embezzling More Than $641K From Millsboro American Legion

MILLSBORO, Del.- Five Sussex County men are facing theft charges following accusations that they stole a combined total of more than $641,000 from American Legion Post #28 in Millsboro.

According to Delaware's Division of Gaming Enforcement, investigators concluded a felony three-month investigation on Thursday, following the discovery of the theft in January. The investigation first began when leaders of the legion voiced concern of "discrepancies" found in the budget. 

"We discovered discrepancies," said Commander Austin Govin. "That were turned over to the law department. To the authorities. And they took over from there."

The DGE said the investigation revealed that six officers of American Legion Post #28 Millsboro, either past or present, had stolen funds between July 2012 and January 2015 by writing and signing numerous checks out to cash and then cashing the checks at local banks. The DGE said a total of $641,100 was taken and never returned to the American Legion post. 

"It's a bad situation," said Govin. "And it’s a shame that this has taken place. And I take no pleasure in seeing my comrades on the news."

Investigators said they obtained arrest warrants on the suspects for charges related to embezzlement and executed a search warrant at the Millsboro home of 65-year-old Samuel Mauger

Mauger was charged with two counts of felony theft over $100,000; $376,660 total. The four other suspects were identified and charged as follows:

  • James Gallagher, 65, of Millsboro, charged with two counts of felony theft over $1,500; $13,000 total
  • Edward Mazewski, 69, of Millsboro, charged with two counts of felony theft over $1,500; $20,000 total
  • Michael Rooney, 66, of Georgetown, Del., charged with two counts of felony theft over $1,500; $13,000 total
  • Charles Nimmericher, 53, of Millsboro, charged with misdemeanor theft under 1,500; $400 total

All five were arranged and released pending a future court date. 

According to the DGE, a sixth suspect was identified for stealing $218,040 in funds, but that suspect is dead.

“From what I hear from people," said Govin. "Things have not been right for years. And you know, I’ve been a member for this post for going on 19 years. I never really saw things or discovered things until this past year.”
