Prosecutors Seek to Reargue Case of Killer Who Was Freed

DOVER, Del. (AP)- State prosecutors are seeking to reargue the case of a convicted murderer who was released from prison last week after a judge cited her model conduct and extensive rehabilitation efforts as an inmate.
    
Fifty-six-year-old Barbara Culp was released from prison and began serving probation after a Kent County judge granted a defense motion to modify her sentence for the 1998 shooting of her boyfriend, Lee B. Hicks.
    
The judge said Culp had demonstrated "extraordinary circumstances" that justified a reduction in her sentence.
    
In court papers Monday, prosecutors said the judge was barred from considering a second motion for sentence modification after Culp's initial motion was denied in 2003.
    
Prosecutors also argue that the judge erred in concluding that Culp's educational and rehabilitative achievements in prison amounted to "extraordinary circumstances."
