LEWES, Del. (WBOC/AP)- Police say a former Delaware lawmaker has been charged in a domestic dispute with his ex-girlfriend.
Delaware State Police announced in a statement Sunday that 46-year-old John C. Atkins of Millsboro has been charged with offensive touching and criminal mischief. Police spokesman Sgt. Richard Bratz said the former state representative surrendered to authorities.
Police say a woman called 911 Friday to report an altercation with Atkins. She told police that Atkins had permission to remove property from her home in Lewes, but when she discovered other items were taken, she tried to damage items in his truck. She claimed Atkins pushed her against her vehicle and kicked her vehicle before leaving.
Atkins was released on $1,000 unsecured bond. He did not respond to WBOC's request for comment. 

This is not the first time Atkins has had a brush with the law. He was first elected to the Delaware Legislature in 2002 as a Republican representing the Millsboro area, but he resigned from his seat in March 2007 in the aftermath of an October 2006 traffic stop in Ocean City, Md., where he was stopped on suspicions of drunk driving. It was later determined that Atkins flashed his legislative identification badge to officers in an attempt to gain leniency. 

Despite a preliminary breath test indicating a blood-alcohol content of 0.14, nearly double Maryland's legal limit, police did not cite or arrest Atkins for the 2006 stop, according to reports from the Associated Press; however, Atkins was charged with offensive touching shortly thereafter for a dispute with his wife in Millsboro.

In 2008, Atkins won back his former House seat after switching to the Democratic Party. He lost to Republican challenger Richard G. Collins in the 2014 election.
