Three Arrested in Fight at Diner in Harrington

HARRINGTON, De.-   Harrington Police arrested three people after fight at a restaurant.  It happened around 2:30 Sunday morning at Rudy's Diner.  

Police say 27 year old Matthew Layton and 24 year old Philip Rust were inside when they began making derogatory comments toward another man, 21 year old Gavin Smith.  Police say Smith then confronted Layton and Rust and it escalated into a fight, even causing some damage in the diner.  

The three men were arrested and charged.  Layton and Rust face charges of conspiracy in the third degree, offensive touching, criminal mischief under $1000, and disorderly conduct.  Smith was charged with offensive touching, criminal mischief under $1000, and disorderly conduct.  All were released on unsecured bond.
