Del. Inmate Challenges Visual Body Cavity Searches

DOVER, Del. (AP)- A federal appeals court says a prisoner can pursue a claim against Delaware corrections officials challenging what he calls were unwarranted and invasive visual body-cavity searches.
    
Donald Parkell claims that being forced to strip and squat three times a day while being held in an isolation unit so guards could examine him violated his constitutional protection against unreasonable searches.
    
Reversing a lower court ruling, the appeals court this week said state officials haven't plausibly explained how inmates being held in isolation and clothed only in underwear and socks would have thrice-daily opportunities to smuggle in contraband from outside or fashion harmless objects in their cells into something dangerous.
    
The court sent the case back to district court, saying Parkell could pursue injunctive relief to try to stop the practice.
