Millsboro Man Accused Of Pulling Gun During Fight

LONG NECK, Del.- Delaware State Police say they have arrested a Millsboro man after he allegedly pulled out a gun during a fight at a restaurant Monday evening. 

Troopers were called to the Long Neck Diner at 25935 Plaza Drive following reports of a disorderly person. Troopers said that when they arrived, 22-year-old Harvey Justice had already left the restaurant.  But witnesses told police Justice had gone to the diner earlier and began looking around his girlfriend’s car that was parked outside. Police said the girlfriend, who works at the restaurant, went outside and noticed Justice around her car and quickly returned inside when Justice allegedly forced his way into the kitchen and confronted her.  Police said a fight broke out between the two and the fight spilled into the parking lot of the restaurant. Troopers said two other employees then went outside, saw what was happening and tried to break them apart, when Justice allegedly pushed his girlfriend to the ground and pulled a gun from a holster attached to his belt.  Witnesses told police Justice then pointed the gun at all three of them and threatened to shoot.  Shortly thereafter, Justice fled the scene in his car.  

Police said Justice's girlfriend was slightly injured but did not request medical treatment.  The other two employees were not hurt.

Troopers and officers from the Millsboro Police Department went to Justice’s address in Millsboro where he was taken into custody without further incident. Police said they a fully loaded 9mm handgun was also located and recovered.

Justice was transported back to Troop 7 where he was charged with three counts of aggravated menacing, possession of a firearm during the commission of a felony and second-degree assault.  He was arraigned at JP3 and committed to Sussex Correctional Institution on $5,250 secured bond.
