Jury Deliberating in Daycare Trial

GEORGETOWN, Del. - A twelve person jury is now deliberating in the case of Valerie Handy, the woman charged with first-degree murder by abuse or neglect after a 10 month old boy died in her home-based daycare last January.

The trial--in Delaware Superior Court-- has been going on for well over a week. Prosecutors allege Handy gave the 10-month-old boy diphenhydramine, the active ingredient in Benadryl. The medical examiner said the boy's death was homicide by diphenhydramine intoxication. 

The jury deliberated for a few hours Thursday afternoon before posing a question over what exhibit or testimony mentioned applesauce. Judge T. Henley Graves said he'll address that tomorrow morning. 

Before the jury left for the evening, the judge reminded them they were court ordered to not discuss the case with anyone.

The jury will return at 9 a.m. tomorrow morning to continue deliberations.
