Prosecutors: Del. Soccer Tournament Killer Not Eligible for Death

DOVER, Del. (AP) - Prosecutors say a gang member sentenced to death after a soccer tournament shooting that left three people dead is not eligible for the death penalty.
    
Delaware's Supreme Court is set to hear arguments Wednesday in an appeal by Otis Phillips, who was convicted of murder in the 2012 killing of soccer tournament organizer Herman Curry at Wilmington's Eden Park.  He was also convicted of manslaughter in the death of 16-year-old soccer player Alexander Kamara.
    
In answering Phillips' appeal, prosecutors say that because his conviction is on direct appeal and not considered final, he is covered under an August state Supreme Court ruling declaring Delaware's death penalty unconstitutional.
    
The Supreme Court is hearing arguments in a separate case Wednesday on whether that ruling applies retroactively to 12 other men facing execution.
