DEWEY BEACH, Del.- The driver of the car that crashed into a popular Dewey Beach restaurant in August -- causing a massive fire that left the business in ruins -- pleaded not guilty Tuesday afternoon to DUI and criminal mischief charges.

During her arraignment, which was her initial court appearance, 36-year-old Michelle Small of Wyoming, Del. was given a case review date of Jan. 17, according to the Delaware Department of Justice.

Authorities said Ed's Chicken and Crabs, a 38-year-old restaurant at 2110 Coastal Highway was destroyed in the early hours of Aug. 9 when Small crashed her car into the building, causing it to burst into flames. According to Dewey Beach police, Small was drunk behind the wheel, driving at a fast speed, when she lost control of her car, and crossed the center median.

Small was originally charged with DUI, reckless driving and failure to have insurance, but those charges were dropped in favor of a grand jury indictment. But new charges of DUI and criminal mischief were filed against Small earlier this month, resulting in Tuesday's arraignment.

Nearly Half of July's Overdoses Were in Sussex County

The opioid epidemic continues to ravage the nation, including here in Sussex County where nearly half of the deaths from drug overdoses this month are from Delaware's southern-most county.

The recent spike has prompted a state warning specifically targeted at heroin users. According to the release, the uptick may be the result of heroin being laced with fentanyl, a synthetic opioid much more powerful than most drugs.
