Controversial Frederica-Area Re-Zoning Once Again Under Consideration

FREDERICA, Del.  Owners of land near Frederica that was partially re-zoned last year for commercial purposes are asking for conditions needed to re-zone the property to be removed.

The land in question lies on more than 25 acres of land just south of the DE Turf Complex off Route 1. It was mostly re-zoned last year for commercial purposes with a segment remaining under the existing agricultural zoning code.

That re-zoning was predicated on the condition that the land be subdivided and deed-restricted with the intention of blocking the construction an exit for commercial businesses on Pritchett Road, which touches one end of the property.

Attorney John Paradee, who is representing landowners Bob and Cathy Murphy, said an agreement with another landowner that would have allowed for a commercial exit to be constructed in another location has fallen through and the couple seeking to have the commercial section of the property re-zoned without any conditions.

Paradee said the conditions laid out by the county are illegal and said legal action could be taken if Levy Court commissioners don't approve the re-zoning without conditions.

The proposal was being considered Thursday night by Kent County's Regional Planning Commission, which will render a recommendation on the merit of the re-zoning request.
