Man Charged With 3rd Offense DUI, Assault on Lewes Officer

LEWES, Del.- A man is facing multiple charges, including third-offense DUI and assault on a law enforcement officer, after he attacked an officer attempting to take him into custody, according to the Lewes Police Department.

Police said the incident happened at around 8 p.m. May 25, when officers were dispatched by Sussex Communications after receiving numerous 911 calls about an intoxicated driver recklessly operating a pickup truck east on Savannah Road near Cedar Avenue.

As officers were responding, a witness who was following the truck, reported it was at the intersection of Kings Highway and Savannah Road parked with two wheels on the sidewalk. Police said that upon officers’ arrival, a man later identified as Fred T. Higgins, 31, of New Castle, was standing in the roadway yelling and screaming at people at a nearby restaurant while holding a can of beer.

Police said that as officers were attempting to calm Higgins down, he continued to yell and as they attempted to take him into custody, he punched a Lewes police officer several times.

Authorities said that during the incident, which was witnessed by several independent people, Higgins was taken to the ground and eventually handcuffed.    

Higgins was subsequently arrested and charged with third-offense DUI, second-degree assault (causing injury to a law enforcement officer), resisting arrest, terroristic threatening, failure to submit to fingerprinting and photographs, criminal mischief (two counts for damage to police equipment) and civil violation of possession of drug  paraphernalia

Higgins was committed to SCI on a bail of $10,000.

The officer who was attacked was treated and released for abrasions to his hands, elbow and knee, police said.
