Delaware House Committee Clears Marijuana Legalization Bill for Floor Vote

DOVER, Del.- House lawmakers on Wednesday advanced a bill legalizing recreational marijuana in Delaware for a floor vote.

House Bill 110 was released by committee members and could be voted on by the full chamber. It is unclear if the legislation will be voted on before the conclusion of the legislative calendar on June 30.

The legislation would allow for the possession and use of up to 1 ounce of marijuana by anyone at least 21 years old and establish a system to tax marijuana sales at retail stores credentialed by the state but also does not allow people to grow their own pot.

The bill calls for state government to collect a 15 percent tax on retail sales price of marijuana, as well as licensing fees. The bill calls for state government to collect a 15% tax on retail sales price of marijuana, as well as licensing fees.

Democratic Gov. John Carney remains wary of legalizing marijuana for recreational use, but Democratic Attorney General Kathy Jennings supports the idea.

Other opponents of the measure include the Delaware State Police and the state medical society.

A bill legalizing recreational marijuana got out of committee during the previous General Assembly but was defeated in a floor vote.
