Clay Conaway Trial Closing Arguments

GEORGETOWN, Del.- The ninth day of the State vs. Clay Conaway trial began Thursday at 1 p.m. with the state and defense's closing arguments. Former University of Delaware baseball player Clay Conaway is accused of raping a woman at his home in June of last year. 

The jury heard closing arguments from both the prosecution and the defense. Once deliberations begin, the jury will consider first-, second-, or fourth-degree rape charges. Judge Richard Stokes defined first-degree rape as sexual intercourse without an individual's consent and causing injury. Second-degree rape is sexual intercourse without an individual's consent and not causing injury. Lastly, fourth-degree rape is sexual penetration of an individual without consent. The judge explained how all of the cases must include intent. 

During the prosecutors' closing argument, they stated that Conaway should be found guilty of first-degree rape. Prosecutors said they believe the accuser did not consent to sex and suffered hip pain as a result of the alleged rape. 

Conaway's defense team argues the accuser presented inconsistencies throughout her testimony. Defense attorney Joe Hurley says they are questioning the accuser's credibility through her text messages, intentions, and how she was diagnosed with hip strains days after the alleged rape. 

Stokes told the Sussex County jury to reconvene Friday at 9 a.m. to decide on Conaway's fate.
