Kent County Seeks Ability to Issue Fines Over Property Maintenance

DOVER, Del.- The Kent County Levy Court Commissioners were scheduled Tuesday to vote on a resolution formally asking Delaware's legislature to allow the county to issue fines directly to owners of properties that fall into disrepair.

House Bill 87 would authorize the county to move forward with establishing regulations regarding property maintenance and penalties for violations of those rules.

Levy Court leaders have said the county needs to be able to directly issue fines for violations to property maintenance rules because the only existing options under existing laws are taking a property owner to court or placing a lien on a property. Some commissioners have said those methods are ineffective at deterring repeat offenders or property owners from ignoring code violations.

HB 87 passed in the House earlier this year but did not get a floor vote in the Senate.
