DOVER, Del. (AP) - A federal judge has refused to dismiss a lawsuit filed by a Delaware prison inmate injured during a softball game.

The judge ruled Friday that Lawrence Dickens could pursue his claims against the former warden of Vaughn Correctional Center and two deputy wardens.

Dickens collided with another softball player in August 2014, suffering a bicep tendon injury.

Dickens was seen 19 days later by an off-site orthopedist, who recommended quick surgery, noting that the ideal window of five to 10 days post-injury had already passed. In October, the orthopedist canceled the scheduled surgery because it was too late to repair the tendon.

Dickens claims the wardens refused to allow the prompt medical attention he needed.

According to the ruling, Dickens is permanently deformed and has limited use of his arm.
