Magistrate Says Suit by Injured Robber Should be Dismissed


WILMINGTON, Del. (AP)- A federal magistrate is recommending that a judge dismiss a civil rights lawsuit filed by a man who claims he was roughed up by employees of a Newport pizza shop he robbed.

The magistrate recommended in a court filing Wednesday that Nigel Sykes' civil rights and assault claims against employees of Seasons Pizza and police officers be dismissed with prejudice.

According to court records, Sykes robbed the pizza shop at gunpoint in November 2010, but employees were able to grab him and gain control of the gun. They then allegedly began kicking, punching and pouring hot soup on Sykes, rendering him unconscious.

Sykes claimed that in addition to being assaulted by the employees, he was shocked repeatedly with a stun gun by responding police officers while handcuffed.
