Ohio PFAS Settlement Triggers Additional Payments to Delaware

DELAWARE - The Delaware Attorney General's Office announced a PFAS settlement in Ohio will result in an additional payment of $25 million to Delaware.

DuPont Co. and its two spinoffs, Chemours and Corteva, announced a settlement of PFAS liabilities with the State of Ohio that triggers contingencies in a 2021 Delaware settlement with the same companies.

In 2021, Delaware and the companies announced a settlement agreement over claims of natural resource damage due to PFAS, otherwise known as 'forever chemicals'. That settlement resulted in the companies agreeing to pay $50 million for environmental restoration, improvement, sampling and analysis, community environmental justice and equity grants, and other natural resource needs.

The contingency from that settlement states that the companies would fund up to an additional $25 million if they settle similar claims with other states for more than $50 million.

Attorney General Kathy Jennings issued the following statement:

"We are thrilled that our forward-thinking settlement with Dupont and others is now $25 million more valuable to the State of Delaware.  That’s 50% more to restore our natural resources, to support public health initiatives in impacted communities, and to keep our neighbors healthy."
