Clayton Police Chief Pleads Guilty to First Offense DUI, Resigns

CLAYTON, Del. (WBOC/AP)- A Kent County, Delaware police chief set to go to trial on a drunken driving charge has pleaded guilty and resigned his post.

Forty-eight-year-old Brian C. Hill, who was chief of the Clayton Police Department, withdrew his not guilty plea Monday morning, and received one year of probation for the misdemeanor first offense DUI of alcohol infraction in the Court of Common Pleas. He must also complete a class and pay some fees.

Court records say a state police trooper found Hill's disabled vehicle parked on railroad tracks on night in 2017. Hill and his attorney filed a motion this year to suppress his breathalyzer results. A judge declined, saying the trooper reported Hill admitted to the charge and asked the trooper "to help him out of a bad situation."

Hill was placed on paid administrative leave two weeks after his arrest, and an acting police chief was appointed. 

Clayton Mayor David Letterman says Hill resigned as chief of the Clayton Police Department on Friday.

“As far as the town is concerned that’s the end of it,” the mayor told WBOC media partner the Delaware State News. “He’s no longer employed. It was a regrettable situation and I’m sorry for what happened but a conclusion had to come some day and I’m glad that it’s here.”
