DOVER, Del.– Legislation signed into law Tuesday by Delaware Gov. John Carney eliminates the so-called "gag clause" that can exist between a pharmacy benefits manager and pharmacy.
The new law is aimed at making it easier for pharmacists to inform patients Delawareans can be informed of the lowest prices for their prescription medications. The clauses could be used to prevent patients from knowing about cheaper medication options available to them.
“We are working hard to make health care costs more transparent for Delawareans because they deserve to have access to direct and clear information – and that includes knowing the prices of their prescription drugs,” Carney said.
Pharmacists bound by a “gag clause” may be prohibited from fully informing patients of medication costs and cheaper alternatives, including whether the patient can pay less for a prescription if they paid out of pocket.
